1. Acceptance of Terms & Data Processing Agreement

By accessing or using Eldovian Simplify, you agree to be bound by these Terms of Service. If you are using the service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Bilateral Contract Integration: These terms explicitly incorporate by reference our bilateral Data Processing Agreement (DPA). By creating an account or using the platform, the Customer and Eldovian Technologies formally execute and bind themselves to the DPA, satisfying the strict requirements for written processor contracts under HIPAA and the Digital Personal Data Protection (DPDP) Act 2023.

2. Acceptable Use

You agree not to:

• Use the service for any illegal purpose or in violation of healthcare regulations.
• Attempt to decompile, reverse engineer, or hack the Eldovian platform.
• Share account credentials with unauthorized individuals.
• Use the service to process data without explicit patient consent where required by laws such as the DPDP Act 2023.

3. Subscriptions & Payments

Access to certain features requires a paid subscription. All fees are non-refundable unless required by law. We reserve the right to change our pricing upon 30 days notice.

4. Limitation of Liability

To the maximum extent permitted by law, Eldovian Simplify shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our service, including errors in generated clinical documentation.

5. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru.

6. Termination

We reserve the right to suspend or terminate your account if you violate these terms or if your actions pose a security risk to our platform or other users.
